Cancellation & Refund Policy

This Cancellation & Refund Policy forms an integral part of the Curapas Terms and Conditions and applies to all Clients who purchase or use Curapas memberships.

Curapas is a non-clinical medical concierge service and does not provide medical care or clinical services.

1. Statutory Right of Withdrawal (14-Day Cooling-Off Period)

In accordance with Dutch and EU consumer law, Clients who are consumers resident in the Netherlands have the right to withdraw from their membership within 14 calendar days from the date of purchase without providing any reason. During this 14-day withdrawal period:

  • Clients may cancel their membership regardless of service usage or circumstances

  • No justification or explanation is required

  • A refund will be issued in accordance with Section 2 below

This statutory right applies only to consumers from the Netherlands and does not apply to business clients or from any other country.

2. Refunds Within the 14-Day Withdrawal Period

If a Client exercises their right of withdrawal within 14 days of purchase:

  • Curapas will refund all amounts paid

  • Refunds will be processed using the original method of payment

  • Refunds will be issued within 14 days of receiving the cancellation request

Curapas may deduct reasonable and demonstrable administrative costs, such as:

  • Payment processing fees

  • Platform or onboarding costs already incurred

Any such deduction shall be proportionate and shall not exceed actual costs incurred.

3. Commencement of Services & Consumer Acknowledgement

For the avoidance of doubt, Curapas services are deemed to commence when any preparatory or coordination activity takes place, including but not limited to:

  • Initial onboarding communication

  • Email, phone, or WhatsApp correspondence

  • Coordination, guidance, or administrative support

By purchasing a membership and requesting immediate commencement of services, the Client expressly consents to the performance of services during the statutory withdrawal period. However, Curapas voluntarily allows cancellation and refund within 14 days regardless of service commencement, without prejudice to statutory consumer rights.

4. Cancellations After the 14-Day Period

Once the 14-day withdrawal period has expired:

  • Memberships are non-refundable

  • No refunds will be issued for partial use, non-use, or unused time

  • Memberships remain valid for the full duration of the selected plan

Failure to utilise services does not constitute grounds for a refund.

5. Travel to India

Travel to India, booking of flights, accommodation, or attendance at medical facilities does not affect the Client’s right to withdraw within the 14-day period. After the 14-day period, travel-related decisions remain the sole responsibility of the Client and do not give rise to any refund entitlement.

6. Third-Party Services & Costs

Curapas does not sell, bundle, or resell third-party services. Accordingly:

  • No refunds are provided for costs incurred with third parties, including but not limited to hospitals, clinics, airlines, hotels, or transport providers

  • Any agreements or payments made directly with third parties remain outside the scope of this Policy

Curapas bears no responsibility for third-party refund policies or outcomes.

7. Exceptional Circumstances

Any refund requests outside the terms set out in this Policy may be considered by Curapas on a discretionary basis only. Any such consideration:

  • Does not create precedent

  • Does not imply entitlement

  • Does not modify this Policy

8. No Medical Guarantees

Curapas does not guarantee:

  • Medical outcomes

  • Availability of specific healthcare providers

  • Timelines, diagnoses, or treatment results

Refunds shall not be granted based on dissatisfaction with medical opinions, outcomes, or third-party services.

9. How to Request Cancellation or Refund

Cancellation or refund requests must be submitted in writing using the contact details provided on the Curapas website. The request must clearly identify the Client and the membership concerned.

10. Mandatory Consumer Rightt

Nothing in this Cancellation & Refund Policy limits or excludes any mandatory consumer rights under applicable Dutch or European Union law.
